Interesting Places and Goings-on

:fella: In reference to this news article about the orphaned works bill, before you get worked up, please read this.

Orphan works is a big problem, and our senators and many people are actually working for the artists and illustrators of our country, trying to work out a reasonable way to make concessions for non-profit and educational use without taking any money away from the artists.

This news article from ASMP explains the situation much better (without all the flagrant, craze-inducing words Mark Simon uses).

The US congress is going to pass some law, at some point, regarding orphaned works. Canada has already passed one, and several European nations are in the process of doing the same. It's not a matter of preventing an orphaned works law from being passed, but in creating one in such a way that it does not infringe upon the income of those who make their living from art and craft.

You can find a lengthy version of the Congress session (and the webcast) here.

Inky, do you have any info on the Canadian Orphan bill? I should know this since I'm Canadian but can't seem to find anything on it.

I have to admit that I got caught up in the " Must stop this!!!" furor but since then I read (or tried to ) the bill in question.

From what I can tell this is to free up artwork that is stuck in limbo, like when the copyright period is still active BUT no one is benefiting it, i.e no living benefactors of the artist etc etc etc.

They say in the bill that somebody can take over the copyrights ONLY after an exhaustive search......

Arrgh I hate legaleeze.......

To me it's like anything else in the world, it could be used for bad but usually isn't.....

But then again if Brad Holland and C.F Payne , two of the all time greats in illustration and fighters for creators rights since forever are worried about this, maybe I should be too....

It's always important to find the facts for yourself and not believe other people, even if they are important figures.

[link] <- There is some information in this Wiki article about Canada's "Orphan Work" policies. I'd also suggest looking for your government's websites (I don't know what they would be in Canada), or doing a google search for "orphan work canada". :aww:

Thanks Inqy!

That's pretty much what I could find too! Shifting thru canadian gouverment copyright paperwork is kinda like being going thru a labyrinth with a blindfold but being led by Stevie Wonder sometimes......you'll find what you want eventually but you usually find what you want by stumbling into it......

Guess I need my weekly copyright, ownership deviantART squabble!!!
